1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you and ZOLLO APP YAZILIM TİCARET LİMİTED ŞİRKETİ ("Licensor", "Zollo Apps", "we") for any mobile application or game published by us (the "Licensed Application"), including any updates. By downloading, installing or using the Licensed Application you agree to this EULA. This EULA supplements our Terms of Use and Privacy Policy.
If you downloaded the Licensed Application from the Apple App Store, this EULA is entered into in accordance with Apple's requirements and, where it conflicts with Apple's Licensed Application End User License Agreement, Apple's standard terms prevail to the extent of the conflict.
2. Acknowledgement
You and Licensor acknowledge that this EULA is concluded between you and Licensor only, and not with Apple Inc. or Google LLC (each a "Store Provider"). Licensor, not the Store Provider, is solely responsible for the Licensed Application and its content.
3. Scope of license
Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple- or Android-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions or the Google Play Terms of Service, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or similar features where supported.
4. Restrictions
You may not: (a) rent, lease, lend, sell, redistribute or sublicense the Licensed Application; (b) copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the Licensed Application, any updates or any part thereof (except as and only to the extent permitted by applicable law); (c) remove or alter any proprietary notices; or (d) use the Licensed Application to violate any law.
5. Maintenance and support
Licensor is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in this EULA or as required by applicable law. You may contact us at support@zollo.app. You and Licensor acknowledge that the Store Provider has no obligation whatsoever to furnish any maintenance and support services for the Licensed Application.
6. Warranty
Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify the Store Provider, and the Store Provider may refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, the Store Provider will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Licensor's sole responsibility.
Except as stated above and to the maximum extent permitted by law, the Licensed Application is provided "as is" without warranties of any kind.
7. Product claims
You and Licensor acknowledge that Licensor, not the Store Provider, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
8. Intellectual property claims
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Licensor, not the Store Provider, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
9. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable export control and sanctions laws.
10. Third-party terms of agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).
11. Third-party beneficiary
You and Licensor acknowledge and agree that the Store Provider and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, the Store Provider will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
12. Termination
This EULA is effective until terminated by you or Licensor. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using and delete all copies of the Licensed Application.
13. Governing law
This EULA is governed by the laws of the Republic of Türkiye, and disputes are subject to the courts and enforcement offices of Antalya, Türkiye, without prejudice to mandatory consumer protection laws of your country of residence.
